Baurocher places great importance on your personal data. This statement ("Privacy Statement") is intended to inform you about the processing of personal data that we may collect when you access our online and offline services, including personal data we collect through our various channels, such as our website and social media.

Baurocher's Cookie Policy complements this Privacy Statement and describes what a cookie is, how Baurocher may use it, and the means by which anyone can accept or refuse the placement of a Baurocher cookie on their device.

When you provide your personal data to a Baurocher entity, that entity is responsible for the local collection and processing of your personal data for the purpose of managing the commercial or contractual relationship related to Baurocher products and services, in accordance with the local laws applicable to it.

In accordance with the General Data Protection Regulation No. 2016/679 adopted within the European Union ("GDPR") and the Federal Act of June 19, 1992 on Data Protection ("FADP"), the Privacy Statement is governed and interpreted by the GDPR and the FADP, under the control of the Federal Data Protection and Information Commissioner, insofar as the French company Baurocher is responsible for defining the overall policy for processing and managing your personal data for commercial and marketing purposes, as well as for managing the Baurocher website.

However, Baurocher may take into account provisions stricter than the GDPR or the FADP when required by law.

We invite you to take the time to read the Privacy Statement in its entirety. We are available to answer any questions you may have at contact@baurocher.com, particularly regarding the exercise of your rights concerning your personal data as described in Chapter VI.

I. PERSONAL DATA WE COLLECT

The Privacy Statement applies to personal data we may collect from or about you (see below) from the following sources:

• Visiting our Baurocher website: particularly when you register on our Site, respond to a form, or use a service (subscription to our newsletter, wish list, job applications), a feature, or resources published on our Site. You will be asked to identify yourself, but you can also visit our Site without registering;

• Electronic and telephone communications between Baurocher and yourself;

• Stores and points of sale managed by Baurocher;

• Purchasing a Baurocher product or requesting after-sales service;

• Calls to Baurocher customer relations centers;

• Printed registration forms or those available on electronic tablets that we collect, particularly in our stores and points of sale or during events;

• Submitting applications to our partners responsible for online collection of applications for positions available at Baurocher;

• Data you publicly share as part of your interaction with Baurocher on social media (e.g., when you "like" a Baurocher page on social media).

We may collect different types of information from you depending on the purpose and how you interact with Baurocher (online, offline, by phone, etc.), as indicated below:

• Personal contact information: This includes any information you provide to us that would allow us to contact you, such as your name, email address, postal address, or phone number, as well as your purchase history and after-sales services you have requested. We may also process images captured by surveillance systems in Baurocher-managed stores and points of sale.

• Demographic information: any information describing your demographic and behavioral characteristics. This includes, for example, your date of birth, gender, nationality, geographical location (e.g., postal code), language preference, other preferences such as your favorite products, your wish list, your professional situation (job title, company/employer, professional contact details), your marital status, your interests (sports, hobbies) or your lifestyle.

• Data relating to traffic and use of our Site: when you interact with our Site, we may collect traffic data using automated data collection technologies, including a dialogue between the website server and your browser. Traffic data may include the browser name and type of device you are using, as well as technical data relating to your connection method to our Site, including your operating system, the IP address of your Internet-connected device, the identifier of your Internet access point, the date and time of your last visit, and the Internet service providers you use. This data is used for statistical purposes, and its analysis helps us improve our Site, to offer you a personalized browsing experience adapted to your preferences and interests, for example, by directly displaying pages in your preferred language during your next visit. This information is collected using automated technologies such as cookies (browser cookies) and web beacons (such as Java Script); it is also collected through external tracking services (Google Analytics). • Customer feedback: this refers to information you voluntarily share with us about your experience using our products and services (for example, in case of a complaint).

• Information from a social network: we may access information that you publicly share on a third-party social network (such as Facebook). If you wish to stop sharing such information, we recommend that you consult the terms of use of the social network concerned.

• Payment information: all the information we need to fulfill an order or that you use to make a purchase, as well as, if you request it, the data necessary for VAT refund (credit card holder's name, card number, expiration date, copy of your identity card, etc.) and the information or documents required by anti-money laundering legislation.

Links to other websites. Our Site may contain or use links to third-party websites (including advertising, partners, or social networks). These third-party websites have their own privacy policies (including on the use of cookies), which we invite you to review. We accept no responsibility for the privacy policies of such third-party websites, which you access at your own risk.

Privacy and protection of minors. Our Site is not intended for users under 16 years of age. We do not knowingly collect personal data from children under 16. If you are a parent or guardian and you know that your child has provided us with personal data, please contact us. If we realize or are informed that we have collected personal data from a child under 16 without verification of parental consent, we will take steps to remove this information from our servers, unless we are subject to a legal obligation to retain it (accounting data or data related to a purchase, data necessary for applicable guarantees or for managing repair requests, etc.). In all cases, users under 16 who have provided us with personal data have a discretionary right to have their data erased, which they can exercise at any time and without reason, alone or through their usual guardian, by contacting us at the address mentioned in Chapter VIII "Contact Us". Erasure requests will be processed under the conditions and reservations described above.

II. USE OF YOUR PERSONAL DATA

We collect and use your personal data for the purposes described below. Please note that the types of use listed below depend on your use of our services and do not systematically concern every user:

• Process your orders, purchases (including any VAT refund requests) and deliveries;

• Respond to your requests, questions and/or demands of all kinds;

• Improve customer service and manage customer relationships, including managing VIP programs and loyalty programs. The collected data helps us respond to your requests, meet your needs more effectively and improve our products and services;

• Regularly send you information, including about Baurocher, news about our products or after-sales services, our events, the opening of new stores, points of sale or satisfaction surveys concerning our products and services, with your consent when required;

• Send you advertising offers and discuss with you on social networks when you interact with third-party social media features such as "like" functions. We recommend that you consult the terms of use of the relevant third-party networks to inform yourself about these features and, if necessary, unsubscribe;

• Provide after-sales services, including under warranty claims;

• Manage and record lost, stolen or counterfeit products;

• Take necessary steps to detect fraud;

• Manage our Site and your accounts, including personalizing your user experience on our Site by also presenting you with Baurocher-specific content that matches your interests. We may also cross-reference this data to better understand how users, as groups, use the services and/or resources accessible on our Site;

• Comply with our invoicing and accounting obligations, as well as our legal and regulatory obligations (such as those resulting from anti-money laundering legislation);

• Process any complaints and disputes (including in the context of exercising legal claims and defenses in case of disputes);

• Produce reports and statistics, particularly for measuring website traffic;

• Manage the recruitment process for applications submitted to our partners responsible for online collection of applications for positions available at Baurocher;

• Ensure the security of stores and points of sale managed by Baurocher.

• Ensure IT security and IT operations.

III. HOW WE PROTECT YOUR PERSONAL DATA

We have implemented appropriate personal data processing practices and security measures to prevent unauthorized third-party access to your personal data and to protect it from alteration, disclosure, or destruction. These security measures primarily consist of strict access and administrator controls, encryption of all personal data recorded in our customer and prospective customer relationship databases, periodic access reviews, constant infrastructure monitoring, and a risk analysis and remediation strategy.

Nevertheless, even though we strive to protect your personal data, we cannot guarantee the security of information transmitted on our Site during its transit via the Internet using an unsecured protocol.

IV. SHARING YOUR PERSONAL DATA

We commit not to sell, exchange, rent, or otherwise transfer your personal data without your consent (given after prior information) and subject to the cases listed below:

• Transfers within Baurocher: The different Baurocher entities may share your personal data with each other to ensure the continuity of our services, our relationship with our customers, prospective customers, and users of our Site, and the offers and information we send you. Your personal data may thus be collected, stored, and processed by a Baurocher entity located in particular in the following countries/regions: Switzerland, the United States, the European Economic Area, China, Taiwan, Japan, Hong Kong, Macau, Singapore, Malaysia, Thailand, Lebanon, and Russia. To ensure a sufficient level of protection, transfers are governed, if necessary, by the contractual clauses in force adopted by the European Commission or through mechanisms validated by it or by the competent authorities in charge of personal data protection within the European Economic Area and, where applicable, supplemented by measures that may be required in other jurisdictions.

• Transfers to third-party providers: In addition, we may disclose your personal data to third parties located abroad for the following purposes:

• We may use third-party service providers to help us operate our business (for example, in connection with order fulfillment, payment processing, fraud detection, identity verification, managing our customer relations centers, sending newsletters, organizing events, managing our information systems, etc.), administer the Site, particularly through the use of Google Analytics, as described in the Cookie Policy.

• In the context of the purposes described in Chapter II above, we may share with our business and advertising partners generic demographic information cross-references that do not contain any direct identifying elements of our visitors for statistical purposes.

• We may disclose this data to a third-party entity in the context of a merger or acquisition, or to any organization involved in a transfer or sale of our business or capital.

We always require these third parties to provide sufficient guarantees of confidentiality and security and to take the necessary organizational and technical measures to protect your personal data in accordance with applicable legislation. To ensure a sufficient level of protection, transfers are governed, if necessary, by the contractual clauses in force adopted by the European Commission or through mechanisms validated by it or by the competent authorities in charge of personal data protection within the European Economic Area and, where applicable, supplemented by measures that may be required in other jurisdictions. Furthermore, service providers are only authorized to access and use your personal data on our behalf for the specific tasks assigned to them, based on our instructions.

• Transfer to third parties for legal reasons: We may disclose personal data to satisfy legal requirements, respond to a request from a competent law enforcement agency, exercise our rights or defend ourselves in the context of a claim or legal proceeding or to provide evidence, to protect the interests of a Rochey entity and combat fraud.

V. RETENTION OF YOUR PERSONAL DATA

We retain your personal data for the period necessary to fulfill the various purposes defined in Chapter II above, except in cases where the law allows or requires us to retain it longer.

In particular:

• Personal data used to manage our relationship with you or to send you information, particularly about Baurocher, new products or after-sales services, events, or satisfaction surveys, will be retained for the duration necessary to manage our relationship with you, and for a maximum of three years from the end of your commercial relationship with Baurocher or your last contact with Baurocher if you are associated with a country in the European Economic Area or Switzerland. This period is extended to ten years if you are associated with the United States and five years if you are associated with another country.

• Data related to the management and history of your purchases and services provided, as well as to the management of complaints and warranty calls, will be retained for a maximum period of ten years from the last event. Baurocher will retain the data you provided in connection with a VAT refund request for a maximum period of one month.

• Personal data processed for managing requests for access and rectification of personal data will be retained for a maximum period of three years.

These maximum periods apply unless you request the erasure or cessation of use of your data before the expiry of these periods for a reason compatible with a legal obligation of retention imposed on Baurocher.

VI. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

Access, modification, update and deletion of personal data: where applicable law provides, you may (i) request to access your personal data held by a Baurocher entity, consult it and obtain a hard or electronic copy thereof, and (ii) request the correction, limitation, update or deletion of your personal data or object to its processing. You may exercise these rights by sending a written request, accompanied by a copy of your identity document, to the Baurocher entity with which you interact or to the postal or electronic address indicated in Chapter VIII "Contact Us" below. We will endeavor to provide you with the personal data concerned, correct or erase it, according to your request and under the conditions provided by applicable law.

Please note that in some cases, we may not be able to delete your personal data without also deleting your user account. Furthermore, we may need to retain some of your personal data after your deletion request, in order to comply with our legal or contractual obligations. We may also be authorized by applicable law to retain some of your personal data to meet our legal obligations.

Opt-out: you may also at any time request to no longer receive information or offers from us, either by following the unsubscribe process described in the messages you receive from us, or by writing to us at the address indicated in Chapter VIII "Contact Us" below.

Portability: given the extreme specificity of the jewelry products designed and marketed by Baurocher, as well as the associated services, Baurocher cannot be subject to portability within the meaning of the GDPR, except for an individual written and specific request addressed to us and justified by a legitimate reason.

Complaint to a supervisory authority: without prejudice to any other legal remedy, you notably have the right to lodge a complaint with the supervisory authority of the European Union competent for the application of GDPR rules or with the Federal Data Protection and Information Commissioner under the conditions provided by the DPA.

VII. CHANGES TO OUR PRIVACY STATEMENT

We reserve the right to modify the Privacy Statement at any time. You will be notified in advance by the publication of a notice on the homepage of our Site. We encourage you to regularly consult this page to be aware of changes and to stay informed about the measures we take to protect the personal data we collect. You agree and acknowledge that it is your responsibility to regularly consult our Site to be aware of any changes made to it.
